Getting A Costa Rican Passport & Its Effect On Dual Citizenship.

by Quatro Legal Immigration Team | Feb. 27, 2024 | Article, Immigration

Embarking on the journey to Costa Rican citizenship is a significant milestone for foreigners who have spent at least seven years living in the country under a temporary or permanent residency visa. The process of naturalization, overseen by the Tribunal Supremo de Elecciones (Supreme Electorate Court), opens the door to a host of privileges, transforming an individual into a proud Tico or Tica. This article will delve into the intricacies of the citizenship application process, shedding light on the two primary routes: through marriage and through residency.

Citizenship through Marriage.

Individuals seeking citizenship through marriage must fulfill the requirement of being married to a Costa Rican citizen for two years, accompanied by a consecutive two-year residency in Costa Rica. It’s crucial to note that the residency timeline pauses whenever the applicant leaves the country and resumes upon their return. This aspect must be considered while calculating the requisite residency period.

Citizenship through Residency.

For those who have been Temporary or Permanent Residents for seven years (for English-speaking countries) or five years (for Spanish-speaking countries), applying for citizenship becomes a possibility. However, a preliminary step involves completing a Temporary Residency process, the details of which will be discussed later in this article.

Unique to the citizenship process through residency is the requirement to pass written tests in Spanish and Social Studies. Although applicants over sixty-five are exempt, all others must pay ₵10,000 for each test. Adequate preparation and language proficiency are prerequisites for initiating the citizenship process.

The general documentation required includes a recently issued Birth Certificate with Apostille/Legalization, a Background Check with Apostille/Legalization issued within the last three months, passport-size pictures, a valid passport with an entry stamp, official translations to Spanish, Sworn Statements from two witnesses vouching for the applicant’s good conduct, a statement from the applicant declaring a clean record with the Costa Rican law, and a Special Power of Attorney. Unlike the Residency process, there are no government fees associated with applying for citizenship.

Testing and Approval Process.

The citizenship process typically takes ten to twelve months for resolution and official approval. Dual citizenship is permitted, allowing individuals to hold citizenship in both their home country and Costa Rica. However, it is essential to check the nationality laws of the home country regarding dual citizenship as some countries do not allow it or have specific rules and regulations.

Benefits of Costa Rican Citizenship.

Obtaining Costa Rican citizenship brings forth a myriad of benefits, including visa-free or visa-on-arrival access to 149 countries, the right to reside and work in Costa Rica, and membership privileges in the Caribbean Community (CARICOM). Additionally, citizens enjoy access to educational and healthcare benefits, and the citizenship process itself is notably low-cost. To apply for a Costa Rican passport, proof of citizenship, such as a birth certificate or naturalization certificate, and a valid identification card must be provided.

Navigating the path to Costa Rican citizenship is a multifaceted process that rewards individuals with a wealth of opportunities and privileges. Whether through marriage or residency, understanding the requirements and benefits is crucial for a smooth and successful journey toward becoming a proud Tico or Tica.
