Before the official handover of the build is done and you are legally allowed to move into your new home, there is a detailed delivery process that ensures the construction meets Costa Rican building regulations and all structural elements comply with architectural blueprints and safety standards.
Key Components of the Delivery Process In Costa Rica
1. Usability
First and foremost, the build must be usable for its intended purpose, even if minor work still needs to be completed. It is important to understand that these minor aspects do not prevent the project from being used and legally delivered to the owner.
2. Financial Implications
The delivery of the project commonly triggers the release of any remaining funds to the builder minus any funds retained to guarantee the execution of punch list items. This is a standard procedure to ensure the builder completes any minor unfinished tasks promptly.
3. Completion of Work
All items, including those listed in the punch list, must be fully completed to consider the project finalized. Final completion marks the conclusion of the construction and signifies that the contractor’s duties have been fulfilled, thus starting the warranty terms.
4. The Final Inspection
This crucial part involves a joint inspection performed by the owner, the inspection team, the contractor, and any relevant parties to the project. The final inspection is designed to identify any deficiencies or issues that must be addressed by the contractor before declaring the work as complete.
5. Certification of Final Completion
When the project is completed, the contractor or technical director of the build must certify that it meets the contractual requirements agreed upon by the parties. During the 30 days following this certification, the contractor or technical director is obligated to inform the Engineers Federate College of the completion of the work.
6. Project Log Closure
All construction projects must keep a copy of the project log, or “bitĂĄcora,” which must be closed within the following 90 days. Final completion marks the official end of the construction contract and signifies that the owner can finally move in or use the house for its intended purpose.
