Applying for residency in Costa Rica can be an exciting step toward building your new life here—but what happens if your application is denied? Here’s what you need to know if your residency application is rejected, including when you can appeal, what happens during the appeal process, and how to reapply if necessary.

Can Immigration Deny My Application?

Yes, the Immigration Department has the discretion to approve or deny a residency application. However, as the video explains, “they are not always right when it comes to rejecting an application.” This is where having an experienced legal team can make all the difference. The good news? “The successful rate is very high” in cases where an appeal is possible. Many denials are issued due to minor technicalities, such as a missing document. In these instances, the court often finds that the Immigration Department was wrong and will “issue a resolution in your favor.”

Common Rejection Reasons and How They’re Resolved

One of the most frequent reasons for rejection is a missing document. According to the video, “If they rejected the case because there was a pending document to be filed, they should ask for the document instead of rejecting the case right away.”

What If an Appeal Isn’t an Option?

If your case cannot be appealed, don’t panic. “You will need to leave the country, do a border run, and start a new application” if you still wish to obtain residency.
